12. Dispute Resolution: Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS,
INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Agreement to Arbitrate. You and WFH Avenue agree that any dispute,
claim, or controversy arising out of or relating to these Terms, your
use of the website, or any products or services purchased through the
site (a "Dispute") will be resolved through binding arbitration on an
individual basis, rather than in court, except that either party may
bring an individual claim in small claims court.
Class Action Waiver. YOU AND WFH AVENUE AGREE THAT EACH MAY BRING
CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND
NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR
REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more
than one person's claims and may not otherwise preside over any form
of a representative or class proceeding.
Arbitration Procedure. Arbitration will be administered by the
American Arbitration Association (AAA) under its Consumer Arbitration
Rules, and will be conducted in Monmouth County, New Jersey, or, at your option,
by telephone or based on written submissions. The arbitrator's
decision will be final and binding, except for a limited right of
appeal under the Federal Arbitration Act.
30-Day Opt-Out. You may opt out of this arbitration agreement by
sending written notice to hr@wfhthebrand.com within 30 days of first
accepting these Terms. Your notice must include your name, order
number (if any), and a clear statement that you wish to opt out of
arbitration. Opting out does not affect any other part of these Terms.
Exceptions. Nothing in this section prevents either party from
seeking injunctive or other equitable relief for claims relating to
intellectual property or unauthorized access to the Services.

These Terms shall be governed by and interpreted in accordance with the laws of the State of New Jersey without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in Monmouth County, New Jersey.
